Intellectual Property Policy

Last updated: 18 October 2026 | Version 1.0

1. Scope and protected assets

This policy explains rights in the Xmadar platform, branding, software and project deliverables, alongside your order and our Terms and Conditions. Copyright, trademark, database and other rights may apply whether or not a registration symbol appears.

2. Xmadar materials

Xmadar and its licensors retain rights in their website design, text, graphics, logos, software, interfaces, documentation, reusable code, templates, processes and pre-existing tools. Access to a service grants only the limited right to use it for its agreed purpose during the applicable term. It does not transfer platform ownership or create an exclusive licence.

3. Permitted and prohibited use

You may use supplied materials within the purchased licence and applicable law. Without permission, do not copy, resell, sublicense, distribute, remove rights notices, impersonate our brand or use our marks in a way that suggests endorsement. Do not reverse engineer or bypass licence protections except to the extent applicable law permits despite a contractual restriction. Statutory exceptions and open-source rights remain available.

4. Your content and accounts

You retain ownership of materials, data, domains and accounts you lawfully own. You grant Xmadar a limited permission to host, reproduce, adapt and transmit your materials only as needed to perform your instructions, secure the service and fulfil legal obligations. You must obtain necessary permissions for text, images, fonts, music, code and personal data you provide. We do not acquire ownership merely by hosting or managing your project.

5. Bespoke deliverables

The order or statement of work must specify whether bespoke code, design and other deliverables are assigned or licensed, the included files, permitted uses and any payment conditions. An assignment takes effect only under a valid written agreement and its stated conditions. Unless expressly included, reusable components, internal tools, working files and pre-existing technology remain with their owner; any licence necessary to use agreed deliverables should be recorded. No term removes mandatory customer rights.

6. Third-party components

Third-party software, open-source packages, themes, fonts, media and platform accounts remain subject to their own licences and fees. A transfer of a deliverable does not transfer third-party ownership or authorise use beyond those licences. Required attribution and notices must be retained. Ongoing paid licences and renewals must be identified in the agreed scope.

7. Portfolio and confidentiality

We do not obtain permission through this policy alone to publish confidential work, customer logos, private screenshots or testimonials. Any portfolio use or publicity requires appropriate permission and must respect confidentiality and personal-data obligations.

8. Report an infringement

Send a report headed “Intellectual Property” to [email protected] identifying the claimant, contact details, protected work, basis of ownership or authority, exact URLs/material complained of and supporting evidence. State that the information is accurate and that you believe the use is unauthorised. Share only necessary information. We may request clarification, notify the affected customer and take proportionate action; a report does not automatically establish infringement.

9. Response and remedies

An affected customer may respond with evidence of permission, ownership or a legal exception. We may restrict disputed material when justified by credible evidence, security needs or law, and reconsider on new evidence. We reserve lawful remedies against infringement and abuse while preserving lawful exceptions and parties’ court rights. Contact support for licensing or reuse requests.
