Server Services Agreement
Last updated: 18 October 2026 | Version 1.0
1. Provider and application
Xmadar is operated by MASSMAAS LIMITED, a company registered in England and Wales under number 08904514. Registered office: 31A Bravington Road, London, England, W9 3AB. Contact: [email protected]. This agreement governs Xmadar VPS, virtual, cloud and dedicated server services purchased under a confirmed order. Read it with the general Terms and Conditions, Privacy Policy, Intellectual Property Policy and any agreed SLA. Server-specific provisions govern their subject; mandatory law prevails. It does not impose server cancellation charges on web hosting.
2. Configuration and delivery
Your order defines processor allocation, RAM, storage, traffic, IP addresses, location, operating system, licences, billing and management level. Availability and delivery dates depend on confirmed capacity and checks. Virtual resources may share physical infrastructure. Dedicated resources, unlimited bandwidth, mitigation capacity or uptime guarantees exist only where expressly stated. IP addresses are allocated for use during the service and are not sold or guaranteed to remain unchanged.
3. Managed and self-managed duties
Unless your order includes management, you are responsible for operating-system and application installation, patching, firewall rules, credentials, content, monitoring and independent backups. For managed services, only the specified tasks are included; root access or customer changes may require coordination and affect support. Extra administration, migrations and third-party licences require an agreed scope and fee.
4. Acceptable use and resources
Do not operate unlawful or infringing services, malware, phishing, spam, attacks, unauthorised scanning or systems that disrupt infrastructure. Respect purchased resource, traffic and licensing limits. Specialist workloads, bulk email or resale outside the plan require approval. We may investigate credible abuse, require remediation and take proportionate protective action. No server may be used to bypass third-party rights or legal obligations.
5. Fees and renewal
The order shows recurring fees, currency, taxes, setup charges, period and renewal arrangement. Automatic renewal requires disclosure and authorisation. Pay due invoices and review renewal dates. Charges for additional resources or excess use must follow disclosed pricing or a separate agreement. New prices apply to future periods after required notice. This agreement does not create an undisclosed long-term minimum commitment.
6. Required 30-day cancellation notice
Give written notice at least 30 calendar days before the requested server termination or non-renewal date, including an end-of-paid-term cancellation. Submit through the customer area or email [email protected] from the registered account email, stating the service ID and requested date. Notice runs from receipt of a clear request; our acknowledgement confirms the date but an internal delay does not postpone a valid notice. Turning off a server, stopping use or stopping payment is not cancellation notice. With full notice, no short-notice cancellation charge applies, but fees already properly due remain payable.
7. Short-notice charge and worked example
If you request termination with fewer than 30 calendar days’ notice, the maximum short-notice charge is the recurring daily service rate multiplied by the missing notice days, capped at one month’s recurring service fee. The monthly equivalent is the recurring service fee divided by the number of months it covers; the daily rate is that monthly equivalent divided by 30. Missing days equal 30 minus the calendar days between receipt and the requested termination date, with a minimum of zero. Deduct any amount already paid or payable for the same days and any costs saved or losses reasonably avoided; do not charge twice for overlapping service or recover more than a lawful, reasonable loss. Example: at £90 per month, 20 days’ notice leaves 10 days; the maximum before deductions is £30. At least 30 days’ notice gives a £0 short-notice charge. We provide an itemised calculation. This is compensation for insufficient notice, not an arbitrary fine.
8. Statutory cancellation and provider breach
The 30-day requirement and charge do not override a consumer’s statutory cancellation, refund or other non-excludable rights, or remedies for our material breach. Where the 14-day distance-contract right applies, the legally permitted rules for requested early service performance govern any proportional charge; accepting this agreement alone does not waive that right. No short-notice charge applies where law prohibits it. Commercial refund offers apply only as expressly disclosed and cannot remove statutory remedies.
9. Security, backups and personal data
Keep independent copies and a recovery plan. Backup, snapshot and restoration services have only the scope and retention expressly included. No absolute security or recovery guarantee is made. You retain rights in your data; where we process it on your instructions, an appropriate data processing agreement must address security, subprocessors, international transfers, rights assistance and deletion. Notify support of compromise without sharing passwords unnecessarily.
10. Suspension, termination and exit
Material breach, overdue fees, serious abuse, security threats or legal requirements may justify proportionate suspension or termination. We give notice and a reasonable opportunity to remedy where practicable; urgent protective steps may be immediate. Suspension does not itself count as your cancellation request. Before closure, export data, transfer dependencies and confirm the deletion schedule. Disks, snapshots, IP assignments and access may be removed after termination under the agreed schedule; indefinite recovery is not promised.
11. Liability and prospective application
General terms govern lawful liability limits, complaints and English and Welsh law, preserving mandatory consumer protections. This agreement and its 30-day notice/charge apply to new orders accepted on this basis and to existing services only after a valid agreed variation and any required notice. Merely publishing or linking this agreement does not retrospectively impose a charge. Arabic and English versions are intended to be equivalent; contact support about any discrepancy.
