Terms and Conditions

Your agreement with Xmadar
Xmadar is a United Kingdom digital services platform. These terms govern xmadar.com, customer accounts, hosting, VPS, domain services, development, website and store management, learning platforms and SEO. Contact [email protected] or open a support ticket. Your confirmed order identifies the contracting supplier and the service purchased.
1. Contract and service scope
The confirmed order, written statement of work and any service-specific agreement define resources, deliverables, fees, billing cycle, milestones and support. A specifically agreed term prevails over these general terms only for its subject matter; mandatory law always prevails. Additional work requires agreement. No unlimited resources, 24-hour support, uptime commitment or search ranking is promised unless expressly included.
2. Accounts and authorised instructions
You must be legally able to contract and authorised to act for the customer you represent. Provide accurate details, secure credentials and use available account protection. You are responsible for authorised users and instructions within your control. Notify us promptly of suspected compromise. Access granted to an integration or team member should be limited to what the service requires.
3. Acceptable use
Do not use our services for unlawful activity, fraud, phishing, spam, malware, copyright infringement, harassment, unauthorised access, attacks or interference with other users. Do not bypass resource limits, licensing or security controls. Resource-intensive activities, bulk email or specialist workloads require prior written approval where outside the purchased plan. We may investigate credible abuse reports and require proportionate corrective action.
4. Hosting, VPS and domains
Resources and management responsibilities are those in the order. Self-managed services leave operating-system, application, patching and configuration duties with you unless expressly included. Domain registration, renewal, recovery and transfer depend on registry rules and timely payment; availability is not guaranteed until registration is confirmed. Keep registrant details and renewal instructions current.
5. Projects, access and acceptance
Provide lawful materials, required access and timely feedback. Delays or scope changes may affect delivery dates and require a revised quote. Review deliverables against agreed acceptance criteria and report specific defects through support. Silence alone does not waive statutory rights. SEO results depend on search engines, competition and your website; no ranking, traffic or revenue outcome is guaranteed.
6. Fees, renewal and payment
Prices, currency, applicable taxes, setup charges and billing periods are disclosed before purchase. Automatic renewal applies only where disclosed and authorised. Keep payment and cancellation settings current. We may restrict an overdue service proportionately after notice where practicable. New prices apply to future periods after any required notice, not retroactively to a paid period. A good-faith invoice dispute should be raised promptly with supporting details.
7. Cancellation and refunds
Request cancellation through the customer area or support, identifying the service and preferred end date. Commercial refunds follow the offer disclosed at purchase and work actually agreed; third-party costs are subject to their disclosed terms and applicable law. No blanket “no refunds” rule overrides statutory remedies. A consumer with an applicable distance-contract right may cancel within 14 days of contract conclusion for services or digital content. Early service performance requires the legally required express request; proportionate charges and loss of cancellation rights apply only when the statutory conditions are met. Immediate digital-content supply requires separate express consent and acknowledgement where required. Acceptance of these terms alone is insufficient. To cancel, email your name, account email, order reference, order date and clear cancellation statement to [email protected]; no special wording is required.
8. Security, backups and continuity
Use secure software and maintain independent copies of important data. Backup frequency, retention and restoration are included only as stated in your plan. No system is risk-free. We will provide services with reasonable care and skill and take proportionate security measures. Planned maintenance and external outages may affect access; an SLA or service credit exists only where expressly agreed.
9. Suspension and termination
We may suspend or terminate for material breach, non-payment, credible security threats or legal requirements. Where practicable, we will explain the reason and offer a reasonable opportunity to remedy; urgent protective action may be immediate. Measures should be proportionate. Request export or migration before termination. Data return, retention and deletion follow the service agreement, privacy policy and applicable law; indefinite recovery after closure is not promised.
10. Intellectual property and confidentiality
You retain rights in your content and grant only the limited permissions necessary to deliver the service. Xmadar retains its pre-existing tools, platform, methods, templates and branding. Ownership or licensing of bespoke deliverables must be specified in the order; payment alone does not transfer third-party rights or our pre-existing technology. Each party must protect confidential material and use it only for the agreed purpose or as law requires. See our Intellectual Property Policy.
11. Responsibility and liability
Each party is responsible for losses caused by its own breach under applicable law. For business customers only, and to the extent lawful, our aggregate liability arising from a service is limited to fees paid for that affected service in the preceding 12 months, and excludes indirect or consequential losses and lost profits. This does not exclude or restrict fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be limited. Consumer services remain subject to statutory standards, including reasonable care and skill.
12. Changes, law and complaints
We notify material changes as required; they apply prospectively and do not remove accrued rights. Contact support first with your order reference and requested resolution. These terms are governed by the law of England and Wales, subject to mandatory protections and court rights in a consumer’s country of residence. Business disputes are subject to the courts of England and Wales. Arabic and English versions are intended to be equivalent; mandatory law prevails and any discrepancy should be referred to support before reliance.
