Web Hosting Agreement

Last updated: 18 October 2026 | Version 1.0

1. Provider and scope

Xmadar is operated by MASSMAAS LIMITED, a company registered in England and Wales under number 08904514. Registered office: 31A Bravington Road, London, England, W9 3AB. Contact: [email protected]. This agreement applies only to web hosting purchased from Xmadar, together with the confirmed order, general Terms and Conditions, Privacy Policy and Intellectual Property Policy. It does not govern VPS or dedicated servers. Service-specific provisions prevail for hosting only; mandatory law prevails.

2. Plan resources and activation

The purchased plan defines websites, storage, traffic, mailboxes, databases, software, management and support. Shared infrastructure is subject to resource limits and fair use needed to protect other customers. There is no unlimited capacity or guaranteed uptime beyond an expressly agreed SLA. Activation follows payment confirmation and required checks; migration, custom configuration and third-party licences are included only if stated in the order.

3. Customer responsibilities

Maintain accurate contact details, secure passwords, access permissions, applications and plugins. You are responsible for lawful content, permissions and your users’ activity within your control. Do not host phishing, malware, unlawful or infringing material, send spam, attack systems or evade resource restrictions. High-resource processes or bulk mail require approval if outside the plan. We may request remediation or an appropriate upgrade, with clear pricing before agreement.

4. Administration, support and security

We manage the hosting infrastructure within the purchased scope; you manage your content and application configuration unless management is included. Support covers the included service during published hours and through supported channels. Code changes, malware cleanup and third-party application work may require a separate quote. We provide reasonable care and skill, investigate reported faults and may carry out maintenance or urgent protective work.

5. Backups and data processing

Keep independent backups. Any included internal backup has only the frequency, retention and restoration scope expressly stated in the plan or confirmed in writing. Do not rely on indefinite recovery after termination. You retain your content rights and are responsible for its lawful collection. Where we process personal data on your instructions, applicable processing terms, security measures, subprocessor and deletion arrangements must be agreed; this agreement alone is not a complete data processing agreement.

6. Billing and renewal

Fees, taxes, currency and billing cycle are shown before purchase. Renewal occurs only under the disclosed and authorised renewal arrangement. Pay invoices when due and submit cancellation before the next renewal is processed if you do not want the next period. Price changes apply prospectively after required notice. Domain registration, domain renewal and external licences are separate unless expressly included.

7. Hosting cancellation and refunds

Request cancellation from the customer area or [email protected], identifying your account and hosting service. Specify immediate closure or the end of the paid period, and request confirmation of the effective date. There is no 30-day server notice charge under this hosting agreement. Where the hosting offer includes the advertised seven-day commercial refund window, request it within seven days of initial activation; renewals and separately disclosed third-party costs follow their own terms, subject to law. This commercial policy supplements statutory remedies and does not replace a consumer’s applicable 14-day distance-contract cancellation right. Early performance requires the legally required express request and information; any lawful proportional charge or loss of a right depends on statutory conditions, not a general checkbox.

8. Suspension, exit and deletion

We may take proportionate action for non-payment, material breach, security threats or legal requirements, with notice and a reasonable opportunity to remedy where practicable. Urgent action may be immediate. Export your files, databases and mail before closure and remove dependencies such as DNS. Ask support for the relevant export window and deletion/backup schedule. Any assistance beyond the plan must be quoted and agreed. Suspension does not transfer ownership of your content.

9. Liability, changes and disputes

The general Terms and Conditions govern responsibility, lawful liability limits and dispute handling. Nothing removes non-excludable liability or consumer rights. Material new obligations apply prospectively after required notice and agreement; publishing this page does not retroactively amend existing contracts. English and Arabic versions are intended to be equivalent. Contact support promptly about any discrepancy or complaint.
